I’m not sure I really was making that point. What I’m saying is that no defendant being taken into custody after “losing” at trial considers this a “win.” It just doesn’t happen. Most defendants don’t think in terms of justice. They think in terms of staying out of jail. If that happens, it’s a win. If not, it’s a loss.
