What is Indecent-Photography?
Under Texas law, indecent photography is the act of using image-capturing devices to obtain images of an individual without the consent of that individual. This can be considered a crime in two ways;
- photographing an individual in a location that’s a private area (bathroom, dressing room),
- and photographing an individual in a location that’s not a private area without the consent of that individual with the intention to invade privacy or satisfy sexual purposes – is a crime.
Additionally, if a person has knowledge of photographs or other media content that could be considered indecent under the law, and promotes said content in any way, they can be charged with indecent photography to the same extent as the individual who initially captured the content.
If you’re facing criminal charges of this kind, and need a competent defense lawyer on your side, our legal team is willing to help you. Contact Attorney Mark W. Bennett at 713-224-1747 to schedule a consultation.
Penalties for Indecent Photography Convictions
In the state of Texas, indecent photography related charges are classified as State Jail Felony offenses.
Convictions for indecent photography can result in prison sentencing of no less than 180 days and no more than 2 years in a state jail facility with a possible fine of up to $10,000. A conviction for such an offense may also require the defendant to enroll in mandatory counseling classes and register as a sex offender.
Furthermore, the criminal penalty for an indecent photography related conviction may be enhanced if:
- any content depicts minors,
- the defendant was responsible for distributing or promoting the indecent content,
- or if the defendant has prior felony convictions.
