The statute and the punishment
The offense is defined in section 550.021 of the Texas Transportation Code. The punishment is at minimum a third-degree felony: 2 to 10 years in prison and a fine of up to $10,000. If the accident resulted in death, it is a second-degree felony: 2 to 20 years.
